These Terms & Services (“Terms”) govern your access to the SmaldiNet Insurance website located at smaldinet.com (the “Site”) and your use of informational tools, forms, and digital resources made available through the Site. By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
SmaldiNet Insurance (“SmaldiNet,” “we,” “us,” or “our”) provides insurance brokerage, advisory, and related services for personal and commercial lines of coverage. We may act as an agent or broker for multiple insurance carriers. Unless a separate written agreement states otherwise, presentation of products on the Site is for informational purposes and does not constitute a binding offer of insurance.
You must be at least eighteen years old and legally able to enter into contracts to submit inquiries or request quotes through the Site. You agree to provide accurate, complete, and current information. Misrepresentation may void coverage applications, delay claims, or result in denial of services. You are responsible for safeguarding any credentials associated with client portals we may provide off-site.
Submitting a quote request, contact form, or newsletter signup does not bind SmaldiNet or any carrier to issue a policy. A policy is formed only after underwriting approval, delivery of policy documents, and payment of required premium according to carrier rules. Policy terms—including limits, exclusions, deductibles, and conditions—control in the event of a loss and supersede general marketing content on the Site.
Insurance is regulated by state and federal authorities. SmaldiNet conducts business only where properly licensed or exempt. Product availability, rates, and discounts vary by jurisdiction, risk characteristics, and carrier appetite. We will identify the capacity in which we act (agent, broker, or consultant) before you bind coverage. Compensation from carriers may be in the form of commissions or fees, as disclosed at application or upon request.
You agree not to misuse the Site. Prohibited conduct includes attempting unauthorized access to systems, introducing malware, scraping content at scale, impersonating another person, submitting fraudulent claims information, or using the Site in violation of applicable law. We may suspend access, report activity to authorities, and cooperate with investigations when misuse is suspected.
All trademarks, logos, text, graphics, layouts, and software on the Site are owned by SmaldiNet or licensed to us. You may view and print pages for personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without prior written consent, except where fair use applies.
The Site may link to carrier portals, payment processors, educational resources, or social networks. We do not control third-party sites and are not responsible for their content, privacy practices, or availability. Your use of third-party services is governed by their terms.
By providing your email address or phone number, you consent to receive transactional messages related to your inquiries, including follow-ups from licensed representatives. Marketing emails are sent only with appropriate consent and include unsubscribe options. Electronic records we maintain may satisfy legal requirements for notices where permitted.
Premium examples on the Site are illustrative. Final pricing depends on underwriting factors such as age, location, claims history, coverage selections, and inspection results. Illustrations for life insurance policies are not guaranteed and assume stated interest or dividend scales where applicable. We reserve the right to correct obvious pricing errors before binding.
Claims are adjusted according to the applicable policy and carrier procedures. SmaldiNet may assist with notice, documentation, and advocacy but does not unilaterally decide claim outcomes. You must report losses promptly, mitigate further damage where safe to do so, and cooperate with adjusters. Fraudulent claims are unlawful and may result in policy cancellation and prosecution.
Our collection and use of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully to understand how we handle sensitive insurance-related data.
THE SITE AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SMALDINET DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. EDUCATIONAL ARTICLES ARE NOT LEGAL OR TAX ADVICE; CONSULT QUALIFIED PROFESSIONALS FOR YOUR SITUATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMALDINET AND ITS OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS (USD) OR THE AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS PRECEDING THE EVENT, WHICHEVER IS GREATER, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
You agree to indemnify and hold harmless SmaldiNet from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Site, or infringement of third-party rights.
These Terms are governed by the laws of the state in which SmaldiNet maintains its principal place of business, without regard to conflict-of-law rules. Except where prohibited, disputes shall be resolved through binding arbitration on an individual basis, and you waive class or representative actions. Either party may seek injunctive relief in court for intellectual property or unauthorized access.
We may update these Terms to reflect regulatory changes, new products, or Site features. Material changes will be posted with a revised effective date. Continued use after changes constitutes acceptance. If you disagree with updates, discontinue use of the Site.
If any provision is held invalid, the remaining provisions remain in effect. These Terms, together with the Privacy Policy and any signed policy documents, constitute the entire agreement regarding Site use.
